TERMS OF USE FOR CUSTOMERS

Version 01 – Effective from April 1, 2025

1. General Provisions

Welcome to Breezing.In E-Commerce Platform (hereinafter referred to as “Platform”), which includes:
(i) The website Breezing.In.vn, registered and operating as an e-commerce website; and
(ii) The mobile app “Breezing.In” on Android and iOS, registered as an e-commerce application allowing merchants, organizations, and individuals to conduct full trading processes for goods and services. The operation model allows users to open virtual stores to showcase and offer products or services, and customers to shop directly.

These Terms of Use (“Terms”) form a legally binding agreement between you (“Customer” or “you”) and Artech Global Pte. Ltd, which owns, operates, and provides various services depending on your needs.

Before using the services on the Breezing.In platform, you must read and accept the terms, conditions, rules, policies, or procedures outlined in these Terms. You agree that:
(i) Your use of Breezing.In’s services will be honest and in compliance with applicable laws;
(ii) You are solely responsible for the accuracy of any information or data posted or created on Breezing.In.

If you do not agree to these Terms, please do not use our services. These Terms may be amended as specified in section 2 below.

2. Modifications to Terms of Use

Breezing.In reserves the right to amend, revise, or supplement any part of these Terms at any time, if deemed necessary. Any changes will become effective immediately upon being posted on the Breezing.In platform.

You agree to regularly check and stay updated with the latest Terms. Continued use of the Platform, even without checking updates, will constitute your acceptance of the modified Terms.

3. How to Use Breezing.In E-Commerce Services

3.1 Account Registration

When accessing the Breezing.In platform (website or app), you must be at least 18 years old or use it under the supervision of a parent or legal guardian. You must also have the full legal capacity to conduct transactions under Vietnamese law.

We will provide you with an account to shop on Breezing.In under these Terms.

You must register with accurate personal information and update it when necessary. You are responsible for the security of your password, account, and all activities that occur under your account. Notify us immediately if you detect unauthorized access. We are not liable for any loss or damage caused by your failure to comply.

You are strictly prohibited from using any part of the platform for commercial purposes or on behalf of third parties without our written consent. Violations will result in immediate account termination without prior notice.

By registering, you agree to receive promotional emails. You may opt out by clicking the unsubscribe link at the bottom of any promotional email.

3.2 Violations of Terms

Your account may be suspended or restricted under the following conditions:

• When there is a written request from competent authorities.

• When Breezing.In detects dishonest activities such as:

  • Fraud or deceitful behavior.

  • Creating fake orders or reviews.

  • Abusing discount codes or promotional programs.

  • Creating multiple accounts to exploit a single promotion.

  • Other fraudulent behavior detected by Breezing.In’s system.

• When a bank, customer, or partner reports suspicious or dishonest behavior.

• Other violations as defined by law.

Breezing.In may take necessary actions, including account suspension, without prior notice.

Account reinstatement may occur under the following conditions:

• Legal authorities confirm transactions are legitimate or disputes are resolved.

• Breezing.In reviews submitted evidence (e.g., invoices, product images) and decides accordingly.

Permanent account termination will occur if:

• No response is received within 30 days of account limitation notice.

• Breezing.In rejects your account recovery request.

• The account is inactive for over 2 years.

• Other legal requirements apply.

3.3 Account/Personal Data Deletion by Customers

You may stop using Breezing.In services at any time. To delete your account and personal data, please contact customer support at hotline: 0708026575 or email hello@breezing.in.

4. Customer Feedback

All content and feedback you provide on the Breezing.In website/app are considered our property. If we detect false information, we reserve the right to suspend your account immediately or take other legal actions.

5. Intellectual Property Rights

Breezing.In and/or its affiliated companies retain ownership of all intellectual property rights related to the platform and its content.

The Organizer acknowledges that customer personal data collected, used, disclosed, stored, transferred, or processed with customer consent is the sole property of Breezing.In.

The Organizer confirms they own or have legal rights to all intellectual property related to the event they provide to Breezing.In, including but not limited to: images, videos, recordings, text, and third-party rights.

The Organizer agrees that:

• Breezing.In has sole and indefinite ownership of customer data and all work products created by or under the direction of Breezing.In.

• Breezing.In owns the copyright and all related rights, including unregistered ones, related to the Platform (“Breezing.In IP”).

• The Organizer will not use any Breezing.In IP without written consent.

• The Organizer will assist in legal procedures for protecting Breezing.In’s IP.

• The Organizer will not copy, disassemble, reverse engineer, or attempt to create source code from Breezing.In’s software or content.

• The Organizer will not alter or remove any IP notices.

6. Privacy Policy

6.1 Information Privacy

By using the Breezing.In platform, you agree to its Privacy Policy, including how your data is collected, used, and disclosed, as outlined in the Information Privacy Policy.

6.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full effect.

6.3 Limitation of Liability

Breezing.In is not liable for any direct or indirect damages related to or resulting from the use or inability to use the Platform. This includes operational errors, delays, viruses, or system interruptions beyond our reasonable control.

6.4 Indemnity

You agree to indemnify Breezing.In, its affiliates, directors, officers, agents, and employees against any claims, damages, losses (including profit loss), and costs (including legal fees) arising from your violation of these Terms.

6.5 Assignment

You may not transfer your rights or obligations under these Terms without written consent from Breezing.In.

Breezing.In may assign or subcontract its rights and obligations to any third party.
